TERMS OF SERVICE & USER AGREEMENT
ARTICLE 1: PREAMBLE AND IDENTIFICATION
1.1These Terms of Service (hereinafter "Terms") constitute a binding legal agreement between the User (hereinafter "The Citizen") and AUTHENTIC WEB MEDIA AGENCY (AWMA) SARL (hereinafter "The Operator").
1.2The Operator is a Limited Liability Company incorporated under the laws of the Kingdom of Morocco.
1.3Headquarters: 131 Bvd D'anfa Res Azur Bureau N° 11 B, 20170 Casablanca, Morocco.
1.4Registry: Registered with the Casablanca Commercial Court under RC 469615.
1.5Tax ID: Identified under ICE 002586128000091.
1.6The Platform "ColorIsLive" is a virtual persistent environment accessible via web browsers and dedicated clients.
1.7By accessing the Platform, creating an account, or purchasing tokens, the Citizen acknowledges having read, understood, and agreed to these Terms in their entirety.
1.8If the Citizen does not agree with any clause herein, they must immediately cease using the Platform.
ARTICLE 2: DEFINITIONS
2.1"Account": The unique user profile registered in the database linked to a wallet address.
2.2"$CLR": The proprietary utility token used within the ColorIsLive ecosystem.
2.3"Planet": A digital asset represented by a Hexadecimal Color Code, mapped to a virtual coordinate system.
2.4"NFT": Non-Fungible Token stored on a blockchain, representing ownership of a digital item or land.
2.5"Smart Contract": Self-executing code on the blockchain that handles transactions automatically.
ARTICLE 3: ELIGIBILITY AND REGISTRATION
3.1The Service is strictly limited to individuals aged 18 years or older.
3.2Minors may only access the platform under the direct supervision of a legal guardian who accepts these Terms.
3.3Citizens from OFAC sanctioned countries are prohibited from conducting financial transactions.
3.4Only one account (Tier 14) is allowed per natural person ("One Human, One Soul" policy).
3.5Creation of multiple accounts (Sybil Attack) to farm rewards results in immediate permanent bans of all linked accounts.
ARTICLE 4: VIRTUAL PROPERTY RIGHTS
4.1"Buying a Planet" grants a license to use a specific coordinate in the software environment.
4.2This license is exclusive, transferable, and revocable only under specific conditions listed in Article 9.
4.3The Citizen acknowledges that Virtual Land is not real estate under Moroccan civil law.
4.4Ownership is proven solely by the holding of the corresponding NFT in a connected wallet.
4.5AWMA does not seize assets, but Smart Contracts may contain automatic liquidation logic (e.g., for unpaid taxes).
ARTICLE 5: THE $CLR ECONOMY AND TAXATION
5.1Nature of Token: $CLR is a utility token. It creates no claim on the equity or profits of AWMA SARL.
5.2Volatility Risk: The value of $CLR fluctuates. AWMA is not responsible for financial losses due to market crashes.
5.3No Redemption: AWMA does not guarantee the ability to exchange $CLR back to Fiat currency (USD/MAD).
5.4Imperial Tax: A percentage of all transaction volume (marketplace sales, rents) is automatically deducted.
5.5Citizens are solely responsible for reporting their crypto-gains to their local tax authorities (Direction Générale des Impôts in Morocco).
ARTICLE 6: USER CONDUCT AND PROHIBITIONS
6.1The Citizen agrees NOT to engage in any of the following prohibited activities:
6.2Hacking: Attempting to breach the server security, inject SQL, or DDOS the infrastructure.
6.3Botting: Using automated scripts to farm resources, move avatars, or snipe market listings.
6.4Duping: Exploiting bugs to duplicate items or currency.
6.5Hate Speech: Publishing content that promotes racism, violence, terrorism, or discrimination.
6.6Real Money Trading (RMT): Selling accounts or items for cash outside the official Marketplace is at the user's own risk.
ARTICLE 7: INTELLECTUAL PROPERTY
7.1AWMA owns all rights to the Platform code, graphics, music, and lore.
7.2Users retain ownership of the original content they create (UGC) and upload.
7.3By uploading UGC, the User grants AWMA a worldwide, perpetual, royalty-free license to display it.
7.4The "ColorIsLive" trademark may not be used for commercial purposes without written consent.
ARTICLE 8: PRIVACY AND DATA PROTECTION (MOROCCO LAW 09-08)
8.1AWMA collects data necessary for the operation of the service (Email, IP, Wallet Address).
8.2Data processing is notified to the CNDP (Commission Nationale de contrôle de la protection des Données à caractère Personnel).
8.3Users have the right to access, rectify, and delete their personal data (excluding immutable blockchain data).
8.4Data may be shared with Moroccan authorities upon valid judicial court order.
ARTICLE 9: LIMITATION OF LIABILITY
9.1The Platform is provided "AS IS" and "AS AVAILABLE" without warranty of any kind.
9.2AWMA is not liable for losses caused by: Blockchain congestion, Wallet hacks, User error, Phishing.
9.3In no event shall AWMA's liability exceed the amount paid by the user to AWMA in the last 3 months.
9.4We are not responsible for the loss of value of NFTs or Cryptocurrencies.
ARTICLE 10: GOVERNING LAW AND JURISDICTION
10.1These Terms are governed exclusively by the laws of the Kingdom of Morocco.
10.2Any dispute arising from these Terms shall first be attempted to be resolved amicably.
10.3Failing amicable resolution within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the Commercial Court of Casablanca (Tribunal de Commerce de Casablanca).
10.4Users waive their right to participate in class action lawsuits against AWMA.
ARTICLE 11: SPECIFIC TECHNICAL PROVISIONS
11.1Terraformation Limits: Users may not alter terrain geometry beyond their owned plot boundaries.
11.2Scripting Limits: Scripts (Tier 6) are CPU-capped. Infinite loops will cause automatic script termination.
11.3API Usage: API keys are personal. Sharing keys or exceeding rate limits (DDoS) is forbidden.

FINAL PROVISIONS
25.1If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force.
25.2AWMA may assign its rights and obligations under these Terms to any subsidiary or successor.
